These Terms of Service ("Terms") govern your use of the website renewbuildpainting.com and any services provided by RenewBuild Painting, LLC ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

RenewBuild Painting, LLC provides professional painting and wallpaper installation services in the Chicago metropolitan area, including but not limited to interior painting, exterior painting, cabinet refinishing, commercial painting, and wallpaper installation and removal.

All services are subject to availability, project scope, and a mutually agreed-upon written estimate or contract. A service agreement is not formed until both parties have agreed to the scope of work and pricing in writing.

2. Estimates and Proposals

Free estimates are provided without obligation. Estimates are valid for thirty (30) days from the date of issuance unless otherwise noted. Pricing may change due to changes in project scope, material costs, or site conditions discovered after the initial estimate.

A written, itemized estimate will be provided prior to commencing any work. The estimate details the scope of work, materials to be used, timeline, and total cost.

3. Payment Terms

• Deposit: A deposit of 30–50% of the total project cost may be required before work begins, as specified in the project agreement.
• Progress Payments: For larger projects, progress payments may be required at milestones specified in the agreement.
• Final Payment: The remaining balance is due upon project completion and client walkthrough approval.
• Accepted Payment Methods: We accept cash, check, Zelle, Venmo, and major credit cards. Credit card payments may incur a processing fee.
• Late Payments: Invoices not paid within 30 days of the due date may be subject to a 1.5% monthly late fee.

4. Scheduling and Access

Client agrees to provide safe, unobstructed access to the work area on the agreed-upon start date and throughout the duration of the project. Delays caused by lack of access, unresolved decisions, or third-party contractors may result in schedule adjustments and potential additional charges.

5. Cancellation and Rescheduling Policy

• Client Cancellation with 72+ hours notice: No cancellation fee. Deposit refunded in full.
• Client Cancellation with 24–72 hours notice: Deposit forfeited to cover scheduling costs.
• Client Cancellation with less than 24 hours notice: Deposit forfeited, plus a cancellation fee of up to 15% of the project total may apply.
• Company Cancellation: We reserve the right to cancel or reschedule due to extreme weather, crew emergencies, or unforeseen circumstances. In such cases, we will provide as much notice as possible and reschedule at no additional cost.

6. Warranty

RenewBuild Painting warrants all labor and workmanship for a period of twelve (12) months from the date of project completion. This warranty covers defects in workmanship, including peeling, cracking, or blistering of applied paint under normal conditions.

This warranty does not cover:

• Damage caused by water intrusion, structural movement, or moisture issues
• Normal wear and tear
• Damage caused by client, third parties, or subsequent modifications
• Areas not included in the original scope of work

Manufacturer warranties on paints and materials are passed through to the client and are subject to each manufacturer's terms.

7. Client Responsibilities

• Remove or identify fragile, valuable, or irreplaceable items prior to work commencement
• Disclose any known lead paint, asbestos, or hazardous materials on the premises
• Ensure all surfaces to be painted are accessible and free from obstructions
• Provide water and electricity access at the work site
• Be available for a final walkthrough upon project completion

8. Lead Paint Disclosure

For homes built before 1978, federal law requires contractors to follow EPA Lead-Safe Work Practices. RenewBuild Painting is EPA Lead-Safe Certified (Certification No. NAT-F308152-1). Clients with pre-1978 homes acknowledge and consent to required lead-safe containment and disposal procedures, which may affect project timeline and cost.

9. Limitation of Liability

To the maximum extent permitted by applicable law, RenewBuild Painting's total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by client for the specific project giving rise to the claim.

In no event shall RenewBuild Painting be liable for indirect, incidental, special, exemplary, or consequential damages, including but not limited to loss of profits, loss of use, or damage to property not directly related to the painting project.

10. Indemnification

Client agrees to indemnify, defend, and hold harmless RenewBuild Painting, LLC and its officers, employees, and agents from and against any claims, damages, costs, and expenses arising from: (a) client's breach of these Terms; (b) client's negligence or misconduct; or (c) inaccurate information provided by client.

11. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Cook County, Illinois, under the rules of the American Arbitration Association, unless both parties agree otherwise. The prevailing party shall be entitled to recover reasonable attorney's fees and costs.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in Cook County, Illinois.

13. Website Use

You agree not to use our website for any unlawful purpose or to transmit any harmful, offensive, or misleading content. We reserve the right to modify, suspend, or discontinue our website at any time without notice.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
